By purchasing one of our photography packages, you (Purchaser) agree to allow your athelete (Athlete), named in the order, to be filmed, videotaped, recorded, and photographed (Footage), and to have their name, image, picture, likeness, voice otherwise recorded, in any media, by Gabriel Foster (G Flicks Productions), designated film crew(s) and video crew(s), and by any other entity authorized by G Flicks Productions to fulfill the requirements of the order.
The quantities listed in the description of services assume that the Athlete will participate in at least one half (1/2) of the sporting event. If the Athlete participates less than one half (1/2) of the event, G Flicks Productions will supply as many pictures as possible, but will not be held responsible if there are fewer than the agreed-upon quantity of images taken.
Purchaser grants to G Flicks Productions the irrevocable, perpetual, fully paid, worldwide right and license to use, and to authorize third parties to use, in all media, the Footage for: (1) news and information purposes, (2) promotion of the specific competition(s) in which Athlete competes, (3) promotion of G Flicks Productions, provided that, in no event may G Flicks Productions use or authorize the commercial use of the Footage in any manner that would imply Athlete or Purchaser’s endorsement of any company, product, or service, without Athlete or Purchaser’s written permission. Purchaser also grants to G Flicks Productions the right to use Athlete’s image by a company that is an official sponsor of G Flicks Productions in advertising and promotions approved by G Flicks Productions. G Flicks Productions agrees not to directly sell Footage of Athlete for profit without Athlete or Purchaser’s written permission.
